Existence of Contract Does Not Always Bar a Claim for Unjust Enrichment

On April 29, 2011, the Indiana Court of Appeals held that a contract does not bar a claim for unjust enrichment if the contract does not fully address all aspects of the parties' relationship in Coppolillo v. Cort, ___ N.E.2d ___ (Ind. Ct. App. 2011), Cause No. 45A05-1007-PL-433. The Court's rationale for its decision is sufficiently ambiguous to be the subject of much dispute in years to come.
Lessons:
