Faulty Workmanship Can Be an Accident under a Standard CGL

On September 30, 2010, the Indiana Supreme Court addressed whether improper or faulty workmanship can constitute an "accident" or "occurrence" under a standard commercial general liability (CGL) policy in Sheehan Construction Co., Inc. v. Continental Casualty Co., 935 N.E.2d 160 (Ind. Ct. App. 2010), Case No. 49S02-1001-CV-32. The Court noted that it had not ruled on this issue, despite the fact that the standard form CGL issued by the Insurance Services Office (ISO), an association of domestic property insurers, had not changed since 1986. While recognizing a divergence of opinion nationwide on this issue, the Court held that improper or faulty workmanship could be an "accident" or "occurrence" and that this depends on the facts of the particular case.

- Faulty workmanship could be covered by a standard CGL policy if the faulty workmanship was the product of unintentional conduct.
- An act will qualify as an accident for the purposes of an insurance policy if it is unintentional.
