Yesterday, the Indiana Supreme Court issued an order setting forth changes to the Rules of Professional Conduct concerning attorney advertising and contact with potential clients, which will become effective January 1, 2011. Notable changes include:
Yesterday, the Indiana Supreme Court issued an order setting forth changes to the Rules of Professional Conduct concerning attorney advertising and contact with potential clients, which will become effective January 1, 2011. Notable changes include:
- A new Rule 7.1, which prohibits false or misleading communications about a lawyer or the lawyer's services.
- Amendments to Rule 7.2, concerning the contents of attorney advertising.
- Amendments to Rule 7.3, which governs direct contact with prospective client. The Rule now explicitly applies to internet communications and includes a 30 day moratorium on direct mail solicitation of any prospective client if the solicitation involves "an action for personal injury or wrongful death or otherwise relates to an accident or disaster involving the person to whom the solicitation is addressed."
- Changes to Rule 7.4, governing fields of practice and speciality, which now recognizes certification "as a specialist by an Independent Certifying Organization accredited by the Indiana Commission for Continuing Legal Education pursuant to Admission and Discipline Rule 30."
- Amendments to Rule 7.5, governing firm names and letterheads, that now allows practice under trade names and the use of uniform firm names across various jurisdictions.
