Partial Judgment Awarding Damages Is Appealable as a Matter of Right

Yesterday, the Indiana Court of Appeals expressed its disagreement with dicta in a prior decision and held that a partial judgment awarding damages is immediately appealable as a matter of right in Coleman v. Coleman, ___ N.E.2d ___ (Ind. Ct. App. 2011), Cause No. 63A01-1009-PL-500. This is a significant change, which may affect the time for many parties to file a notice of appeal.
