Published Opinion Dismisses Appeal Sua Sponte Pursuant to Trial Rule 53.3(A)

Today, the Indiana Court of Appeals sua sponte dismissed an appeal as untimely in Bergstrom v. State of Indiana, 933 N.E.2d 555 (Ind. Ct. App. 2010), Case No. 92A05-1003-IF-170. In this decision, the Court held that a litigant must file a notice of appeal from the date a motion to correct error is deemed denied, if it is not ruled upon within the time frame set forth in Trial Rule 53.3(A).
Lessons:

UPDATE
The Indiana Supreme Court denied transfer in this case on March 3, 2011.
