Trial Rule 7(A) Requires a Responsive Pleading to a Will Contest

Today, the Indiana Court of Appeals issued a decision in Avery v. Avery, 932 N.E.2d 1280 (Ind. Ct. App. 2010), Case No. 49A05-1004-PL-320, in which the Court held that Trial Rule 7(a) requires that a defendant to a will contest action file an answer to the complaint and that the failure to do so entitles the plaintiff to a default judgment.
Lessons:

The Indiana Supreme Court granted transfer in this case on February 10, 2011.
